Agreement to Terms and Conditions

Please read the following terms and conditions carefully. These terms and conditions and undertakings apply to your booking with PurnimaTrasi.com (referred to in these terms as the words “we”, “us”, “our” and similar words also refer to “PurnimaTrasi.com”). By making your booking you are irrevocably agreeing to enter a contract with us on these terms and conditions. That contract becomes binding immediately on our confirmation of your booking.

Because we can change these Terms and Conditions from time to time, we do recommend that you print off a copy and keep them safe. The updated version of these Terms and Conditions will be indicated by an updated “Revised” date and the updated version will be effective as soon as it is accessible. You are responsible for reviewing these Terms and Conditions to stay informed of updates.
We want and expect you to be delighted with any Retreat purchased from PurnimaTrasi.com. If you have any complaints, please email us at yoga@purnimatrasi.com and give us the chance to investigate and, if relevant, try to put things right for you.

1. Prices
​
All advertised retreat prices are subject to availability and can be withdrawn or varied by us for any reason without notice prior to booking and payment of deposit. Prices are quoted in New Zealand dollars (NZD) for retreats held within New Zealand.
We may increase the price of your booking at any time before your booking is paid in full to reflect any changes in our costs related to your booking which are beyond our reasonable control, which may include (without limitation) exchange rates fluctuations, changes in the price of fuel, the level of taxes or fees imposed by third parties including tourist taxes, landing taxes or embarkation/disembarkation fees at ports and airports.

2. Dates and Destinations
​
All advertised and booked retreat dates and destinations are indicative until departure. PurnimaTrasi.com will use reasonable endeavours to ensure booked retreats take place as advertised, however we reserve the right to change or cancel the dates and destinations of retreats for any reason and at any time prior to departure.
In the event we change the dates of a booked retreat pursuant to this clause and either the new date is not suitable for you, or we are unable to provide a new indicative date within a reasonable period after the change, then you will receive a credit note equal to the price paid by you. You will not be entitled to a refund or any other remedy.

3. Payment
​
The advertised deposit must be paid before bookings will be processed. In some circumstances we may require a higher percentage or even all the advertised price to be paid as the deposit (we will make this clear on the booking page). Payment of the deposit means you have accepted our terms and conditions, and you accept this is a non-refundable deposit. We will notify you by email when your booking is confirmed.
Unless otherwise indicated, the balance of the price must be paid in instalments or full as advertised and no later than 15 days prior to the scheduled departure date or earlier subject to individual international operators’ policies. Full payment is required immediately if you make a booking within 30 days of the departure date.
In some circumstances we may offer payment plan alternatives. If we do, and you select that payment alternative, then you must make each payment by the due dates indicated. (we will make these clear on the booking page).
Where full payment or any part thereof is not made by the due date, we may treat your booking as being cancelled by you. In that instance we will retain any applicable cancellation fees and refund the balance of your payment as a Travel Credit in accordance with clause 4.

4. Cancellation by Participant
​
PurnimaTrasi.com will provide a full refund if you cancel within 24 hours of booking and that booking was made 10 days or more before the scheduled retreat date.
Should you choose to pay via the Payment Plan option, however request cancellation before all payments have been made, you will still be required to pay the full amount of the package less any refund in accordance with clause 4.
You must notify us of cancellations and changes to bookings in writing and as soon as possible. Any travel insurance at the time of booking to cover any unforeseen cancellation is your responsibility.
Additionally:
- Deposits are non-refundable;
- Cancellation between 6 months and 30 days prior to travel will incur a cancellation fee of 65% of the total amount of the trip;
- Cancellation later than 30 days prior to travel will mean that the full cost of the trip is non-refundable but transferable.
- Cancellation due to testing positive to COVID-19 within 48 hours of the departure date (prior to the start of the retreat) will incur a cancellation fee of 10% of the total amount of the trip and a Travel Credit will be arranged for the remaining amount. Valid proof of your pre-departure COVID-19 test result must be submitted to PurnimaTrasi.com as proof of cancellation. Self-administered COVID-19 tests will not be accepted, only approved documentation provided by private pathology clinics.

5. Force Majeure
​
In the event of a Force Majeure, there is no refund. Your funds will be placed in a Travel Credit less any unrecoverable costs associated with the trip you have paid for. Your Travel Credit may be used on any PurnimaTrasi.com retreat departure for up to 24 months from your original date of departure. A “Force Majeure Event” includes but is not limited to, acts of God, fire, earthquake, flood, windstorm or other extreme weather events, war, civil commotion, riot, blockade or embargo, breakdown, union dispute, epidemic, pandemic, lack or failure of courses of supply, passage of any law, order, regulation, ordinance, proclamation, demand, requisition or requirement or any other act of any government authority, outside of the reasonable control of either parties whether or not foreseeable, which renders performance impossible.

6. Minimum Numbers
​
Minimum numbers for retreats will depend on the type of package. For overseas retreats, a minimum number of people is required on any given departure date to guarantee that departure.
Where a group falls below minimum numbers, customers will be notified 2 weeks from the intended departure date and receive a full refund. Please ensure you have appropriate level of travel insurance to cover you under most circumstances.

7. COVID-19
​
The pre-departure testing requirements, including types of acceptable tests and documentation required, are set by the countries you are travelling to and transiting through and Airlines may have different policies on entering the flight. It is your responsibility to check latest travel requirements and well before your departure date so you can prepare. You'll also need to ensure you have valid test result documentation to meet the criteria for travel.
If you test positive to COVID-19 prior to your flight home and after the retreat has concluded, all expenses including medical and quarantine are your sole responsibility.
Additionally and as outlined in clause 4;

8. Travel Credits

All travel credits issued by PurnimaTrasi.com pursuant to these terms and conditions or otherwise are valid for use for 24 months from the date of issue. You are not entitled to a refund or any other remedy for any unused portion of an expired travel credit. In our sole discretion we may extend the validity of travel credits for a longer period if we consider we have not provided a reasonable opportunity for the holder to use the travel credit. Please note retreat costs may increase in this transferable time in which case you will be required to pay the difference.

9. Travel Insurance
​
You must obtain a premium travel insurance plan covering all dates and destinations of travel including domestic bookings and we recommend starting this policy at the time of your booking. This is incase of injury, illness, emergency, death medical expenses or cancellation and your policy must include ‘YOGA’. If participating in more adventurous activities such as trekking, then the highest altitude reached during the itinerary must be included as well as emergency repatriation (including helicopter rescue and air ambulance where applicable). You will be required to provide documentary evidence confirming that you hold the above travel insurance prior to departure. We reserve the right to request evidence of your travel insurance and may, in our complete discretion, refuse to provide you the retreat services where you do not hold appropriate insurance.
10. Health and Safety
​
You must be examined by a licensed medical practitioner within the past six months and have been found by such Practitioner able to perform Yoga and all types of movement including but not limited to breathwork, swimming, Remedial Massage and for retreats where trekking is specified, this also includes walking 5000 meters above sea level, which are to be performed during the retreat immersion with PurnimaTrasi.com.
You must complete the health check form and declare any health, medical or dietary issues and requirements to us at the time of your booking and where necessary update that information prior to departure and during the retreat. Based on your disclosures we may require you to provide a medical certificate confirming that it is safe for you to participate in a retreat. Despite your disclosures and any medical certificates provided, you are wholly responsible for your own health, safety and wellbeing at all times during the retreat, including during all activities. You are free to stop or decline participating in any activity at any time for any reason.
You must also ensure that you are aware of any health requirements for your travel destinations and to ensure that you carry all necessary vaccination documentation. You should consult your doctor regarding health requirements for your destination and your suitability to participate in the activities provided.
11. Passports, Visas and Vaccinations

You must ensure you have valid passports, visas, re-entry permits and required vaccinations which meet the requirements of immigration and other government authorities for all locations of your booking unless we have stated on the booking page otherwise. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities are your sole responsibility.
All travelers must have a valid passport for international travel. Many countries require at least 6 months validity from the date of entry. You release and indemnify PurnimaTrasi.com from all responsibility and liability for any refusal of entry, detainment, or other action of immigration or other government authorities which may occur to you in connection with a retreat.
If you need information regarding visa and other travel document requirements for your trip please let us know. We can obtain such information from an external visa advisory service provider on your behalf. We do not warrant the accuracy of such information and accept no liability for any loss or damage which you may suffer in reliance on it.
12. Liability

Subject to law and except as expressly provided to the contrary in these terms and conditions, all terms, conditions, warranties, undertakings, inducements or representations whether express, implied, statutory or otherwise relating in any way to the retreat, our services and these terms and conditions are excluded. Without limiting the generality of the preceding sentence, the Consultant shall not be under any liability to the Client in respect of any loss or damage (including consequential loss or damage) however caused which may be suffered or incurred by you other than as a direct result of our failure or omission to comply with our obligations under these terms and conditions.
Our maximum liability for any act, failure, omission, event or occurrence where our liability is not excluded shall be limited to any one or more of the following: (a) in relation to goods: (i) the replacement of the goods, or the supply of equivalent goods, or payment of the costs of replacing the goods or acquiring equivalent goods; or (ii) the repair of the goods or payment of the cost of having the goods repaired; and (b) in relation to services: (i) the supplying of the services again; or (ii) the payment of the cost of having the services supplied again, as in each case we may elect in our sole and absolute discretion.
13. Privacy

By booking with us you acknowledge that we will collect, use and disclosure your personal information (including to our third party service providers) as we reasonably require to provide the service to you, and for other reasons permitted under privacy laws (including direct marketing).
14. Governing Law
​
These terms and conditions apply to the extent that they are NOT in consistent with, or in contravention of, any obligation imposed on PurnimaTrasi.com by local law in the country of travel.
15. Severability
If any provision of these terms and conditions should be held to be invalid or unenforceable, in whole or in part, the validity of all other provisions of these terms and conditions (and any part of the subject provision which is not held to be invalid or unenforceable) shall not be affected and shall remain in force.
16. Variation

We may make reasonable variations to these terms and conditions from time to time.
17. Special Requirements
Where the facilitated retreat includes arranging food or other necessities, you must liaise with PurnimaTrasi.com within 7 days of your
booking regarding any special requirements you may have (such as special dietary requests). Where we cannot accommodate a request, we will inform you of same.
